10 years after Commission’s Green Paper – Damages actions for breach of the EC antitrust rules (EUR-lex), on 26 November 2015, directive 2014/104/EU of the European Parliament and of the Council on certain rules governing actions for damages under national law for infringements of the competition law provisions of the Member States and of the European has been adopted (EUR-Lex). It should be implemented by the member states by 27 December 2016. The final wording of the above mentioned directive has been strongly influenced by judgements of ECJ, i.a: of 20 September 2001 case C-453/99 Courage and Crehan, of 13 July 2006 joined cases C-295/04 – C-298/04 Manfredi, and recently of 6 June 2013 case C-536/11 Donau Chemie.
