“Small revolution” in Polish trade mark law – switching into the opposition procedure
The Act of 11 September 2015 on amendment of the Intellectual Property Law (text in: ISAP) comes into force today. The most important change as regards the provisions governing national trademarks is the introduction of a new model of the trademark registration procedure.
Instead of the previously applied “examination approach” under which the Polish Patent Office was obliged to examine a trademark applied for taking into account absolute or relative obstacles to registration, an “opposition approach” is introduced.
